Police shooting outside Pa. Kmart called justified

YORK – A central Pennsylvania prosecutor says police officers were justified in shooting and killing a theft suspect who they said pulled a knife on them outside a department store.

York County District Attorney Tom Kearney on Tuesday cleared the two Springettsbury Township officers of any wrongdoing in the Dec. 29 shooting outside a Kmart store.

Police responding to a report of a man with a knife stealing jewelry said 40-year-old Todd Shultz fought with them and pulled a knife after they used a stun gun. Two officers then fired, killing Shultz. Toxicology tests later indicated that that he had cocaine in his system.

Police Chief Thomas Hyers said Tuesday that the case was and will remain “a tragedy.” He said “It doesn’t make it easier for anyone just because it’s closed.”
