WHEELING, W.Va. (AP) – Prosecutors are awaiting the results of evidence tests in the case of two men accused of killing a Wheeling Jesuit University student.

Ohio County prosecutor Scott Smith told The Intelligencer and Wheeling News-Register he’s not sure whether his office will be ready to present the case to the grand jury when it convenes in January.

Twenty-year-old Craig Tyler Peacock of Clewiston, Fla., and 24-year-old Jarrett Mathis Chandler of Winnfield, La., both of whom worked in the gas industry, are charged with second-degree murder in connection with the death of 21-year-old Kevin Figaniak of Perkasie, Pa. Prosecutors say Figaniak was beaten during an argument Aug. 31 and died from his injuries the next day.

Scott declined to comment on the evidence that was sent to the West Virginia State Police Crime Laboratory for analysis.
