Former Democratic committeeman files appeal

Former Washington County Democratic committeeman Milan Marinkovich filed information with the state Superior Court in time for the court to hear his appeal challenging a judge’s decision that he committed elections code violations.
His attorney, Chuck Kurowski, successfully filed the response to the Superior Court’s prothonotary’s office Dec. 31, and it was received Thursday just before the deadline.
Marinkovich is appealing Washington County Judge John DiSalle’s ruling that he misappropriated committee funds and committed elections codes violations.
Marinkovich, who served as the committee chairman from 2002 until he lost the position to current Chairman George Vitteck in January 2008, was removed from the committee in 2011 after DiSalle held him in contempt for not producing requested documents.
In his appeal to the state Superior Court, Marinkovich claims DiSalle’s rulings were tainted because of previous political battles between the two. Marinkovich actively campaigned for Kurowski in the 2005 election for Washington County judge. However, Kurowski lost to DiSalle and former Judge Janet Moschetta Bell in that election.
“As a judge, he should have never overseen that case,” Marinkovich said. “He should’ve recused himself. He was too close to the case.”
A story Friday incorrectly reported that the appeal was over his dismissal as a committeeman in 2011.
The state Superior Court asked that more information be included in his appeal or threatened to dismiss the challenge. That order was filed Dec. 20, and Marinkovich had until Friday evening to submit his response.
