Beallsville man sentenced in accident
WAYNESBURG – A Beallsville man driving with a suspended license when he wrecked his vehicle May 29, causing serious injuries to a Nemacolin teenager, was sentenced Jan. 13 to 22 days to 5 years in jail by Greene County President Judge Farley Toothman.
Alan Thomas Brady, 22, of 23 Oak St., Lot 24, was driving his Jeep Compass on Wahula Road in Cumberland Township when it went out of control, struck a tree and rolled twice. Cumberland Township police Chief Craig Miller said speed was a contributing factor.
Brady, as well as several passengers in his vehicle, were treated for injuries. The most severely injured was Jinell Schiffbauer of Nemacolin, who suffered a broken neck, according to police.
Miller said a teenage passenger lied to officers at the scene, claiming she was driving Brady’s Jeep. She later recanted and told police it was Brady behind the wheel. She said she lied because she was afraid of Brady.
Schiffbauer, a second juvenile female and Joshua Faulk, also passengers in the Jeep, confirmed Brady was the one who was driving.
Faulk, who left the scene before police got there, was located at the residence of a friend and admitted drinking with Brady earlier in the day of the accident. Brady’s blood-alcohol content was 0.081 percent.
Officer Kurtiss Benco said Brady smelled of alcohol following the accident and told Benco he wasdrinking. He admitted there were active warrants for his arrest for failure to pay fines in a previous case.
Brady pleaded guilty to accidents involving death or injury while not properly licensed, driving under the influence of alcohol while incapable of safe driving, one count of intimidating a witness; and six summary traffic violations, including driving while his operating privileges were suspended.
Charges that were withdrawn were aggravated assault by vehicle while DUI, endangering the welfare of children, DUI general impairment, four counts of recklessly endangering another person, obstructing the administration of law enforcement and three additional counts of intimidating a witness.
Brady was ordered by Toothman to pay restitution to one of the juvenile passengers in the amount of $1,943.23, $1,325 in fines, plus court costs and fees and to perform 250 hours of community service.
