Parents sue Pa. district over son’s allergy plan

FOX CHAPEL (AP) – The parents of an elementary school student have sued a Western Pennsylvania school district claiming they wrongly made the boy sit alone in the cafeteria because of his deadly allergy to nuts and didn’t stop the resultant teasing by other students.

The boy isn’t identified in the federal lawsuit against Fox Chapel Area School District.

A district spokeswoman said a hearing officer agreed the district didn’t owe the parents reimbursement for private school tuition they now pay to educate their son.

That officer also found, however, the district wrongly retaliated against the parents by filing truancy citations against the boy and repeatedly delaying hearings on them.

The parents say the boy still had allergic episodes in school and want reimbursed for the tuition.
