UPMC asks judge to throw out city’s tax case

PITTSBURGH (AP) – The University of Pittsburgh Medical Center is asking a federal judge to throw out a city lawsuit challenging its tax-exempt status.
Mayor Luke Ravenstahl argues that the medical center shouldn’t be treated like a charity because it doesn’t act like one. He wants to tax certain exempt UPMC assets.
But the medical center argued Friday that the city’s move is premature, unconstitutional and unfounded.
UPMC had the case moved to federal court last week on the grounds that it involves tax-exempt status under the Internal Revenue Service and raises constitutional questions.
City attorneys have said they may seek to move the case back to Allegheny County Common Pleas Court, arguing that it doesn’t involve constitutional questions.
