Life sentence in torture-murder vacated

GREENSBURG (AP) – A state appeals court has overturned the mandatory life sentence given to a western Pennsylvania woman who was just 17 when she helped several others torture and murder a mentally disabled woman.
The Pittsburgh Tribune-Review reports the Superior Court has ordered Angela Marinucci – who is now 21 – be resentenced for her role in the February 2010 killing of 30-year-old Jennifer Daugherty.
The decision is based on a U.S. Supreme Court decision outlawing automatic mandatory life sentences for juvenile offenders.
Westmoreland County District Attorney John Peck says he’ll ask that Marinucci be resentenced to life when she’s resentenced. Defense attorney Michael DeMatt says he’s still fighting to have Marinucci’s conviction overturned by the state Supreme Court.
If that fails, he’ll seek less than a life sentence for Marinucci.
