Six admitted into ARD program

WAYNESBURG – Six criminal defendants were entered into the Accelerated Rehabilitative Disposition program Tuesday by Greene County Judge Farley Toothman.

Those accepted into the program must serve at least one year probation and pay all fines and costs. Defendants charged with driving under the influence of alcohol also may have their driving privileges suspended and be required to refrain from the use or possession of alcohol.

Those who successfully complete the program can petition the court to have their criminal records expunged. Admitted were:

Michael Todd Phillips Jr., 23, of 733 Rudolph Run Road, Spraggs, charged with driving under the influence of alcohol and two summary traffic violations; arrested April 17, Phillips had a blood-alcohol content of 0.159 percent, police said.

Martin Luther McDowell, 48, of 106 First St., Mather, charged with possession of drug paraphernalia, disorderly conduct and a summary traffic violation; a charge of possession of marijuana was withdrawn; stopped by police March 9, McDowell had a small amount of marijuana and a pipe, police said.

Shawn Allen Fields, 35, of 773 Browns Creek Road, Sycamore, charged with driving under the influence of a controlled substance, possession of a small amount of marijuana, firearms not be carried without a license; on May 13, after his vehicle hit a guardrail at a gas station in Waynesburg, a small amount of marijuana and .22-caliber pistol were found in his vehicle. Police said Fields told them he had taken Xanax and Suboxine that day. He was entered into the program for two years.

Amber Kay Busch, 48, of 123 Stone Church Road, New Stanton, charged with three counts of unlawful acts, two counts criminal solicitation to commit acquisition and one count criminal attempt to commit acquisition by misrepresentation, fraud, forgery or subterfuge; between May 21 and June 11, Busch called in three prescriptions to pharmacies in Waynesburg for Clonazepam and Klonopin without a doctor’s authorization. Busch was entered into the program for two years.

Michael Matthew Dulik, 44, of 103 First St., Crucible, charged with DUI; arrested June 9, Dulik has a BAC of 0.230 percent.

Zachery A. Michael, 29, of 163 W. Elm St., Waynesburg, charged with theft and receiving stolen property; between June 10 and 14, Michael, a cashier at Walmart, allegedly stole $1,042 from the register and a $30 gift card.
