Man sentenced to 90 days in jail for DUI

WAYNESBURG – A Carmichaels man found guilty by a Greene County jury of driving under the influence of alcohol, his second offense in 10 years, was sentenced Tuesday to five years in the county intermediate punishment program.

Aaron Justin Ewart, 43, of 35 Route 21 Mobile Home Park, was found guilty by a jury Oct. 2 of DUI, driving while his operating privileges were suspended or revoked and two summary traffic violations.

Ewart had been stopped for a traffic violation Nov.3, 2011, by Cumberland Township police. Police said they smelled alcohol on his breath. He refused a blood-alcohol test.

Under the sentence imposed by Judge Farley Toothman, Ewart will serve 90 days in jail. He will be permitted work release and the start of his jail sentence was deferred for 30 days. Ewart also was ordered to pay $2,550 in fines and to perform 125 hours of community service.
