EVANS CITY (AP) – A Western Pennsylvania bus driver waived his right to a preliminary hearing on charges stemming from a crash with a train that killed two of his passengers and injured several others.

Mike Pawk, the defense attorney for 59-year-old Frank Schaffner, said Monday’s waiver isn’t part of any plea deal with Butler County prosecutors.

The Pittsburgh Tribune-Review reported the Butler Township man is charged with homicide by vehicle, involuntary manslaughter and other crimes in the April 26 crash that killed 91-year-old Claudette Miller and 88-year-old John Burkett.

Authorities said surveillance video shows Schaffner drove through a fog-shrouded railroad crossing without stopping the small bus carrying senior citizens and people with disabilities.

Authorities said the passengers saw and heard the train approaching and question why Schaffner apparently did not.
