A preliminary hearing for a California of University of Pennsylvania basketball player was continued until next month at the request of the prosecution.
Jeremy Posey, 19, of Huntingdon, Huntingdon County, was arrested March 9 by California police for allegedly raping a fellow student inside an apartment at Vulcan Village.
Assistant District Attorney Kristin Clingerman asked District Judge Valarie Costanzo Wednesday for the continuance prior to the start of the hearing scheduled in Central Court.
“There are some additional matters we are looking into,” Clingerman told the judge in asking for a continuance of three weeks.
Defense attorney Jill Sinatra agreed to the continuance.
“But I don’t want it to drag out much longer than that,” Sinatra told Costanzo.
The 19-year-old woman told California police she had invited Posey to a gathering. When the party dispersed, the woman said, she went to her bedroom about 4 a.m.
Posey reportedly followed her to her room, but she told him that she wanted to go to sleep. While she was trying to sleep, she told police Posey started groping her and she told him to stop. The woman said Posey started sodomizing her, and that she lay motionless until the assault was over.
Posey, who is also charged with involuntary deviate sexual intercourse, indecent assault, reckless endangerment and aggravated indecent assault, is free on $30,000 bond. Although no problems have been reported, Clingerman asked Costanzo to include a provision to the bond that Posey have no contact with the woman. Posey also faces disciplinary action from the university.
