PITTSBURGH (AP) — Prosecutors have dropped a robbery charge against a University of Pittsburgh student who dressed as Spider-Man after a convenience store owner testified he believes the incident was just a “silly mistake.”

Jonathan Hewson, 21, was expected to be released from the Allegheny County Jail on Tuesday.

He was arrested shortly after police say he walked into the store about 1:10 a.m. Sept. 20 — dressed in the superhero costume — and asked “How much money you got?”

Hewson’s friends say he’s simply a Spider-Man enthusiast who meant no harm. At a preliminary hearing Tuesday, store clerk Bob Patel told a district judge he didn’t want to ruin Hewson’s college career saying, “He just made a silly mistake.”

Hewson’s attorney hopes to get his arrest record expunged and Hewson readmitted to school.
