3rd-degree murder conviction in Philly shooting

PHILADELPHIA (AP) – A northeastern Philadelphia man has been convicted of third-degree murder in a shooting death at a restaurant in the trendy Northern Liberties section of the city last year.
Steven Miller, 24, showed no emotion as jurors announced the verdict Monday in the June 2012 murder of Maurice Kimble, 24, on the patio of the PYT restaurant, The Philadelphia Daily News said.
Miller was also convicted of firearms offenses but acquitted of first-degree murder in the shooting, which authorities said occurred after the victim made a pass at a woman Miller knew.
Assistant District Attorney Richard Sax said he would seek the maximum term of 28½ to 57 years in prison.
“He was callous. He had no remorse whatsoever,” Sax said, adding that Miller shot the unarmed Kimble because the victim had the temerity to speak to the woman,
Defense attorney Samuel Stretton, who argued that his client acted in self-defense, said he would seek a sentence of 15 to 30 years.
“The jury had some healthy doubt as to whether this was just a purely vicious, intentional killing of an unarmed man, as opposed to someone having a gun and something else happening there,” Stretton said.
