Death penalty not sought in Pa. car wash slaying

EBENSBURG – A man charged in the stabbing death of his girlfriend at a western Pennsylvania car wash last summer will not face the death penalty if convicted of first-degree murder.

Twenty-one-year-old Demetrius Gibson of Johnstown is charged in the Aug. 6 slaying of 21-year-old Elizabeth Ann Miller in Moxham.

The Tribune-Democrat said prosecutors told a Cambria County judge during Gibson’s arraignment Tuesday that they would not seek the death penalty.

State law requires a defendant and his attorney to be notified if prosecutors plan to seek execution.

At a hearing last month, a witness said Gibson and Miller had been fighting the night before the stabbing.

Defense attorney Thomas Dickey said he will seek a jury trial on charges of criminal homicide, aggravated assault and simple assault.
