EBENSBURG (AP) – A man charged in a shooting death outside a western Pennsylvania bar earlier this year will not face the death penalty if convicted of first-degree murder.

The Tribune-Democrat of Johnstown reports that Cambria County prosecutors announced Tuesday that they would not seek capital punishment in the case of 33-year-old Joshua Cambric of Johnstown.

First Assistant District Attorney Heath Long said the necessary elements to seek the death penalty weren’t present in the slaying of 33-year-old Tony Phillips of Lower Yoder Township outside Edder’s Den in Johnstown.

Authorities allege that Cambric fired into a vehicle in the parking lot and hit Phillips, who later died at Conemaugh hospital. They said none of those involved were patrons of the bar.

Another man was charged with hindering apprehension in the case.
