Area man sentenced for simple assault

WAYNESBURG – A California man found guilty by a Greene County jury of assaulting a man at the Greene Cove Marina was sentenced Thursday by Greene County Judge William Nalitz to two years in the county intermediate punishment program.

Mark Francis Scholl, 48, of 166 Skyline Drive was arrested July 7, 2013, after he punched and choked Brandon Durbin, a man whom he employed.

Durbin was using a light from a cellphone as he untangled knots in an anchor line on the boat Scholl was attempting to dock.

Scholl claimed the light from the cellphone shined in his eyes.

Scholl punched Durbin repeatedly in the face. Later, when Durbin asked Scholl why he had struck him, Scholl threw him down and began choking him, police said.

Scholl denied striking Durbin. He told police Durbin’s eye injuries were caused by a fall.

A jury convicted Scholl of simple assault in September. The court also found him guilty of harassment.

Scholl’s sentence of county intermediate punishment will include 30 days of house arrest with electronic monitoring.

He also was ordered to complete a course in anger management, pay a $1,000 fine and perform 90 hours of community service.
