A Bentleyville man accused of engaging in a sex act with a 12-year-old boy almost four years ago waived his case to court after several counts were dismissed by the prosecution.
Anthony Capodieci, 71, of 6 Liberty St., had been scheduled for a preliminary hearing in Central Court Wednesday before District Judge Ethan Ward. He waived a hearing on one count each of rape of a child, statutory sexual assault, involuntary deviate sexual intercourse, indecent assault of child less than 13 years old, indecent assault of a child less than 16 years old and corruption of minors.
Two counts each of rape of a child and statutory sexual assault were dismissed, along with eight counts of each of the other charges. He remains free on $50,000 unsecured bond.
