Man sentenced on third DUI offense

WAYNESBURG – A Waynesburg man who pleaded guilty to his third driving under the influence offense and an ignition interlock system violation was sentenced Friday by Judge Farley Toothman to the county intermediate punishment program.

Scott Allen Mathieson, 33, of 982 Jefferson Road, was arrested June 28 after his vehicle was stopped on Route 88 by Cumberland Township police for a traffic violation.

Mathieson’s speech was slurred and his eyes red and results of field sobriety tests indicated impairment, police said. Tests indicated a blood-alcohol content of 0.149 percent.

Mathieson also was driving a vehicle with an ignition interlock system and he told police he bypassed the system to start the vehicle by coasting it and engaging the clutch.

Mathieson pleaded guilty Nov. 13 to driving under the influence of alcohol, third offense in 10 years; tampering with an ignition lock; illegally operating a vehicle not equipped with an ignition lock; and two summary traffic violations.

For the DUI offense, Mathieson was sentenced to 5 years in the county intermediate punishment program, which according to the judge’s order, includes 30 days in jail, 11 months of house arrest and the remaining time under regular supervision.

He also was sentenced to a concurrent 90 days to 1 year in jail for the ignition interlock offense, which would increase his minimum jail time to 90 days. Mathieson was granted work release.

He also was ordered to pay $2,850 in fines, perform 350 hours of community service and to continue with mental health treatment. He is prohibited from consuming or possessing alcoholic beverages.
