Local man sentenced to 30 days on 3rd DUI

WAYNESBURG – A Waynesburg man who pleaded guilty to his third driving under the influence of alcohol offense and an ignition interlock system violation will spend 30 days in jail and be permitted work release, according to an amended sentence issued Friday by Greene County Judge Farley Toothman.

Scott Allen Mathieson, 33, of 982 Jefferson Road, was sentenced Jan. 10 on the DUI offense to five years in the county intermediate punishment program, which according to Toothman’s initial order, would include 30 days in jail, 11 months on house arrest and the remaining time under regular supervision.

The initial order also called for Mathieson to serve a concurrent 90 days to 1 year in jail for the ignition interlock offense, which would increase his minimum jail time to 90 days.

An order issued Friday clarified the sentence. Toothman said Mathieson will serve 30 days in jail and be permitted work release; he also will spend 11 months on house arrest and the remaining 48 months under regular supervision.

Mathieson was arrested for DUI June 28, his third DUI offense in 10 years. He also had bypassed the ignition interlock system on his vehicle, a device used to prevent him from driving drunk. Mathieson entered an open plea to the charges Nov. 13.

In other cases before the court, Travis L. Eisiminger, 31, of 1712 Morris St., Waynesburg, was sentenced Thursday by Toothman on charges of DUI, his second offense in 10 years, and four summary traffic violations.

Eisiminger was arrested May 11 and had a blood-alcohol content of 0.195 percent.

He was sentenced to five years in the county intermediate punishment program, which will includes 30 days in jail, five months of house arrest and the remaining time under regular supervision. Eisiminger will be permitted to serve his jail time on weekends.

Robert Keith Banal, 41, an inmate at the State Correctional Institution at Greene, pleaded guilty Friday before Toothman to harassment and was sentenced to 90 days concurrent to his present sentence. A charge of simple assault was withdrawn.

Banal, serving 6 to 12 years on arson charges out of Allegheny County, punched another inmate several time in the head July 20 while they were playing cards. The other inmate was treated for a broken orbital bone and broken nose.
