Judge resentences Wind Ridge man

WAYNESBURG – A Wind Ridge man who pleaded guilty in March to homicide by vehicle and was sentenced to three years in the county intermediate punishment program was resentenced Tuesday after violating conditions of his sentence.
Travis John McFadden, 22, of 105 Bristoria Road, was removed from intermediate punishment and sentenced by Judge Farley Toothman to 9 to 36 months in prison after admitting he violated conditions of his sentence related to drug and alcohol use.
McFadden’s vehicle was involved in a head-on collision on Route 18 in Jackson Township at 6:30 a.m. June 6, 2012. The crash claimed the life of Keith Allen Conrad, 54, of Morgantown, W.Va.
McFadden was driving east and entering a curve when his 2005 GMC Sierra pickup truck ran off the road onto the south berm, police said. He attempted to steer back onto the roadway, but his truck crossed into the westbound lane and crashed head-on into Conrad’s 2010 Kia Soul.
Police estimated McFadden’s truck was traveling 75 miles per hour in a 55 mph zone. A Greene County coroner’s jury recommended in September 2012 that McFadden be charged with homicide by vehicle.
On March 11, 2013, McFadden pleaded guilty to homicide by vehicle, recklessly endangering another person, driving on the wrong side of the highway and driving at a safe speed.
He was sentenced to three years in the county intermediate punishment program that included 90 days in jail and nine months of house arrest.
In his resentencing order, Toothman noted McFadden admitted to violating three conditions of his initial sentence involving the use of alcohol and a controlled substance. Though alcohol was not a factor in the fatal crash, his sentence prohibited him from using or possessing illegal drugs or alcoholic beverages.
In August, McFadden admitted to his probation officer he drank beer. An empty case of beer was found in his home, according to court documents. In December, he admitted to smoking marijuana and had earlier used someone else’s urine for a probation office drug test.
