Waynesburg man sentenced for DUI

WAYNESBURG – A Waynesburg man was sentenced Wednesday by Greene County Judge Farley Toothman to five years in the county intermediate punishment program for driving under the influence of alcohol, an offense he committed while awaiting sentencing for a previous DUI arrest.
John Robert Joseph Fahey, 30, of 2214 Garards Fort Road, was arrested Oct. 27 after driving the wrong way on Greene Street, a one-way street, in Waynesburg. He had a blood-alcohol content of 0.231 percent.
At the time of his arrest, Fahey was awaiting sentencing on a previous DUI. Fahey pleaded guilty in August for a Feb. 2, 2013, DUI, in which he had a BAC of 0.197 percent.
The February DUI was his second DUI in 10 years. He was sentence in December by Toothman to five years in the county intermediate program.
Because he was not sentenced for the February DUI when he was arrested for DUI again in October, the October DUI was not counted as an additional DUI for sentencing purposes. It, too, was listed as a second offense DUI.
The five years in the county intermediate program imposed Wednesday for the October arrest was ordered to be served concurrent to the previous sentence.
Under the new sentence, Toothman ordered Fahey to serve the first three months of the sentence in house arrest. Fahey was granted work release privileges.
He also was ordered to pay $1,550 in fines and to perform 275 hours of community service. He is prohibited from the use, purchase or transportation of alcohol. Fahey pleaded guilty to the new DUI charge April 15.
In other business before the court, Stephanie Renee Imler, 26, of Duncansville, was sentenced Thursday by Toothman to 90 days to 5 years in jail for driving under the influence of a controlled substance, her second DUI offense.
Imler was arrested Aug. 20, 2011, after her vehicle struck the rear of another vehicle on the ramp onto Interstate 79 in Washington Township. A blood test indicated Alprazolan and Methadone in her system. She pleaded guilty to the charges April 15.
Imler also was fined $1,550 and ordered to serve 225 hours of community service.
Toothman ordered that her sentence be served concurrant to a sentence she is serving for two cases in Blair County, one for theft and receiving stolen property and the other for conspiracy to commit theft, reckless endangering another person and disorderly conduct.
Peter J. Forgen, 56, of 505 E. Greene St., Carmichaels, was sentenced Wednesday to five years in the county intermediate punishment program charged with DUI, second offense. He pleaded guilty to the charges April 15.
Forgen was arrested Nov. 1 after a single-vehicle crash in Morris Township. His BAC was 0.169 percent.
According to the order, Forgen will serve one year of his sentence on house arrest. He also was order to pay $1,550 in fines and perform 90 hours of community service.
