Several defendants entered into ARD

WAYNESBURG – Several criminal defendants were admitted to the Accelerated Rehabilitative Disposition program Monday.
Those accepted into the program must serve at least one year of probation and pay all fines and costs.
Defendants who enter the program charged with driving under the influence of alcohol also may have their driving privileges suspended and be required to refrain from the use or possession of alcohol.
Those who successfully complete the program can petition the court to have their criminal records expunged.
Admitted were:
Susan Marie Garber, 50, of 1119 Big Shannon Run, Mt. Morris, charged with driving under the influence of alcohol, driving under the influence of alcohol general impairment and a summary traffic violation; Garber was involved in an accident July 17 at the intersection of East High St. and South Woodland Ave., in Waynesburg Borough. Police said Garber ran a stop sign and drove into the path of a vehicle driven by Scott Blair of Waynesburg. Garber’s blood alcohol content was 0.095 percent. She received a 60-day driver’s license suspension.
Mervin Lee Barbe, 77, of 207 Parkview Knoll, Carmichaels, charged with driving under the influence of alcohol and two summary traffic violations; Barbe was stopped by state police May 22 after he was seen turning onto Ceylon Road without signaling. His BAC was 0.153 percent. Barbe received a 30-day driver’s license suspension.
Agnes Amanda Marie Thomas, 26, of 21 Eastview Court, Waynesburg, charged with DUI of a controlled substance, driving under the influence incapable of safe driving, and three summary traffic violations; Thomas was driving on an expired registration Oct. 16 when she was stopped by borough police as she pulled along the shoulder of Greene Street. Police said Thomas admitted smoking marijuana. A blood test revealed THC in her system. Thomas received a 60-day driver’s license suspension.
Jesse James Famularo, 23, of 108 Richland Ave., Canonsburg, charged with possession of a controlled substance, possession of drug paraphernalia and disorderly conduct; Waynesburg Borough police officers, acting on a tip about drug sales, went to 54 N. Morris St., Apt. 19, where Famularo was living April 25. Famularo and his roommate allowed police to search the residence. Famularo admitted he had sold marijuana to a few students at Waynesburg University but would not give names to police. Drug paraphernalia was found inside the apartment. A plastic baggie containing .92 grams of marijuana, $290 from admitted sales of the substance, and a scale for weighing it were located inside a safe. All of these items belonged to Famularo, who said his roommate was not involved in any way with the drugs or the sale of them.
Raymond J. Hetrick, 28, 100 River Road, East Millsboro, charged with DUI, DUI incapable of safe driving, and four summary traffic violations; Carmichaels Borough police pulled Hetrick over Sept. 20 after witnessing him cross the center line on Roy Furman Highway near Glades Run Road. Police said Hetrick also crossed the solid white line at least six times. He received a 60-day suspension of his driver’s license.
