DA: Keep charge in accidental Pa. shooting death

UNIONTOWN (AP) – A Western Pennsylvania prosecutor says an involuntary manslaughter charge should remain in the accidental shooting death of a woman last summer because the defendant’s actions were grossly negligent.
Twenty-four-year-old Jeremy Hamborsky of Connellsville is charged in Fayette County in the August shooting death of 23-year-old Kylie Sage. Authorities say he was handling a handgun she had just purchased as the two sat in Sage’s pickup truck when it went off.
Defense attorney Emily Smarto filed a motion to dismiss the case in April, saying the commonwealth would be unable to prove its case.
The (Uniontown) Herald-Standard reports that prosecutors contend that Hamborsky had been drinking and failed to confirm that the gun was unloaded, calling that “clear evidence of an indifference to the consequences of his actions.”
