Charges filed for attempted pistol purchase

Charges of unsworn falsification to authorities and sale or transfer of firearms were filed Thursday in Greene County against a Washington County man.

Kenneth James Axton, 50, of 2800 Main St., Beallsville, attempted to purchase a pistol at the True Value Hardware store in Dry Tavern Feb. 10 and the Pennsylvania Instant Check system denied his purchase.

According to a criminal complaint filed before Magisterial District Judge Glenn Bates, Axton told police he did not think he had filled out the instant check form incorrectly. Police said Axton told them he wanted to purchase the firearm because he makes night deposits at his place of work and he thought he needed protection.

Police said Axton is ineligible to purchase a firearm due to a previous guilty plea for simple assault in 2010, and to a 2009 driving under the influence charge where he was admitted into the ARD program.

A preliminary hearing is pending.
