Asbestos appeal dropped, CSX awarded $7.3 million

MORGANTOWN, W.Va. (AP) – A settlement has been reached in a civil racketeering lawsuit over fraudulent asbestos claims.
CSX Transportation announced Thursday it had reached a settlement agreement with attorneys and a radiologist who allegedly filed fraudulent asbestos claims against the company. CSX will be paid damages and legal fees of $7.3 million.
The agreement comes more than seven years after CSX made the accusations in West Virginia federal court. A jury sided with CSX in 2012. A judge eventually awarded CSX $7.3 million.
The attorneys and radiologist appealed in February. They argued their case last month in the 4th U.S. Circuit Court of Appeals in Richmond. On Thursday, they filed a motion to dismiss the appeal.
A CSX press release says the award will go to CSX Foundation, a non-profit organization affiliated with the company.
