NCAA asks Pa. court to end Penn St. legal battle

HARRISBURG (AP) – The NCAA wants the Pennsylvania Supreme Court to end litigation over the 2012 consent decree with Penn State over the school’s handling of the Jerry Sandusky child molestation scandal.

Pennlive.com reported Thursday the NCAA made a court filing last week asking the justices to order a lower court stop the case, now set for trial in January.

The NCAA is arguing a Commonwealth Court judge shouldn’t have kept the legal battle alive by “ordering further litigation on an issue no party before it had raised.”

Pennlive.com said state Treasurer Rob McCord and state Sen. Jake Corman, the plaintiffs in the case, want the high court to stay out of it.

The consent decree includes a $60 million fine and the temporary loss of scholarships and postseason eligibility.
