HARRISBURG, Pa. (AP) — A central Pennsylvania prosecutor says he won’t file charges in a fatal shooting after determining the shooter had a right to defend others against an armed attacker.

Dauphin County District Attorney Ed Marsico announced the decision one day after 23-year-old Craig Everette II shot to death 60-year-old Todd Eugene Taylor in a suburban Harrisburg home.

Police say Taylor broke into the home and shot through a bathroom door, wounding his estranged wife’s boyfriend.

Everette, who also lives there, had fled out a back door when shooting started, then returned and shot Taylor to death.

Police say Taylor had been threatening his estranged wife’s boyfriend for several weeks.

Everette disarmed Taylor after shooting him, then went to a neighbor’s house to wait for police to arrive.
