Greene County Court pleaders
WAYNESBURG – A number of criminal defendants pleaded guilty this month before Greene County President Judge Farley Toothman.
Ross C. Wise, 32, of 1057 Old Lake Lynn Road, Lake Lynn; offenses – driving under the influence of alcohol, third or subsequent offense; accidents involving damage to property, six summary traffic violations; Wise was arrested Jan. 19 after his vehicle crashed into a telephone pole and building on Route 21 in Cumberland Township; his blood-alcohol content level was 0.084 percent; sentence, 30 days to 1 year in jail, $3,400 in fines.
Paul Andrew Hewitt, 52, of 137 Petain Ave., Nemacolin; offenses – driving under the influence of alcohol and a controlled substance, possession of drug paraphernalia; on May 1, Hewitt’s vehicle crashed into the rear of a school van on Route 88 in Cumberland Township; he was under the influence of alcohol and heroin and in possession of hypodermic needles; sentence, 72 hours to 1 year in jail, $1,025 in fines, 100 hours of community service.
Brandi J. Stallard, 32, of 235 Third St., Crucible; offenses – two counts of retail theft; on Sept. 18, Stallard stole three shirts from The Fashion Shop in Waynesburg and $20.27 worth of candy and other merchandise from Pecjak’s Sunoco; sentence, 2 years of probation, 50 hours of community service, restitution.
Alyssa Theresa Ortiz, 22, of 305 Parkview Knoll, Carmichaels; offense – retail theft; on Dec. 21, 2014, Ortiz loaded a cart with $740 in merchandise at Walmart in Franklin Township and attempted to leave the store without paying; sentence, 1 year of probation, 25 hours of community service.
Douglas Andrew King, 24, of 139 WW Railroad Road, Sycamore; offenses – accidents involving personal injury, accident involving injury while not properly licensed, 10 summary traffic violations; on Oct. 26, 2013, King crashed his vehicle on Route 18 and fled on foot, several people in his vehicle were injured; sentence, 2 years of probation, $560 in fines.
Joseph William Haywood, of 53 ½ S. Richhill St., Waynesburg; offense – possession of a controlled substance; on July 1, 2014, a rock of cocaine was found in his possession when his vehicle was stopped by police; sentence, 1 year of probation, $300 fine, 75 hours of community service.
Joshua D. Brewer, 27, of 502 Lippencott Road, Waynesburg; offenses – criminal trespass, loitering or prowling; on June 29, 2014, Brewer was with another man who broke into a house in Waynesburg and stole food and clothing, a television also was damaged; sentence, 2 years of probation, 125 hours of community service, $599 in restitution.
Joshua Franklin Davis, 28, of 220 Kurans Road, Carmichaels; offenses – theft, receiving stolen property; between Aug. 6 and 13, 2014, Davis stole foreign currency and a letter opener together value at $19.21 from a house where he was working in Washington Township; sentence, 1 year of probation, $250 fine.
Cody Daniel Kisner, 23, of 124 Orchard Ave., Brave; offenses – two cases, theft; on Feb. 19, Kisner stole $12,686 worth of equipment from a Coastal Drilling well site in Gilmore Township; driving from the site he was involved in a rollover crash on Roberts Run Road; fleeing or attempting to elude police and seven summary traffic violations; on March 5, Kisner failed to stop his vehicle for police for a traffic violation on Route 218; sentence, 5 years in the county intermediate punishment program with the first six months in jail, credit for time served from Oct. 17, restitution.
Joshua A. Ruse, 38, of 272 S. Washington St., Waynesburg; offense – two cases of DUI, the second his fourth or subsequent offense in the last 10 years, 10 summary traffic violations; stopped by police on Feb. 15, 2013, Ruse had a blood-alcohol content level of .144 percent; on Aug. 2, 2014, after running his motorcycle into a ditch, he had a BAC was .203 percent; sentence, 32 months to 11 years in jail; if eligible for the Recidivism Risk Reduction Incentive Program, his minimum will be reduced to 24 months; he also received credit for time served from Aug. 27 and was fined $1,500.
Six criminal defendants were entered into the accelerated rehabilitative disposition program this month by Greene County President Judge Farley Toothman.
Those accepted into the program must serve at least one year probation and pay all fines and costs. Defendants charged with driving under the influence of alcohol also may have their driving privileges suspended and be required to refrain from the use or possession of alcohol.
Those who successfully complete the program can petition the court to have their criminal records expunged.
Cody Ray, 27, of 111 Fourth St., Clarksville, charged with driving under the influence of alcohol and two summary traffic violations. Arrested Jan. 22, following a traffic stop, Ray had a blood-alcohol content level of .309 percent.
David Morris Riley, 53, of 498 Morford Road, Aleppo, charged with DUI and three summary violations. Arrested June 6, after his vehicle struck a guardrail on McCracken Road, Riley had a BAC of .208 percent.
Devin Richard Tennant, 19, of 436 Stringtown Road, Carmichaels, charged with theft, access device fraud, receiving stolen property. On March 5, Tennant used another person’s access card to withdraw $90 from the person’s account.
Anthony Mathew Montalbano, 25, of Folsom, charged with DUI and a summary traffic violation. Arrested June 21, following a traffic stop, Montalbano had a BAC of .138 percent.
Freddy Dwight Morris, 65, of Clarksville, charged with unsworn falsification and sale or transfer of a firearm. Morris attempted to purchase a handgun Jan. 23 at Ozie’s Sport Shop and failed to indicate on his ATF form his earlier treatment for mental health issues.
Jordan Richard Johnson, 23, of Crown City, Ohio, charged with DUI and a summary traffic violation. Arrested April 10, 2014 folowing a traffic stop, Johnson had a BAC of .143 percent.
