Trade group files Act 13 suit

Pennsylvania Independent Oil and Gas Association of Pennsylvania, Wexford, filed legal action Friday with the Pennsylvania Supreme Court to enforce portions of the court’s ruling on Act 13, the state’s oil and gas law.

The nonprofit trade group asked the court to stop the state Department of Environmental Protection from requiring well permit applicants to comply with the provisions of the law the court previously found unconstitutional and unenforceable.

In a December 2013 decision, the Supreme Court ruled certain sections of Act 13 unconstitutional in a lawsuit brought about by Robinson Township and three other municipalities. A section of Act 13 that directs the DEP on the decisional process of issuing permits was negating in that ruling.

“DEP has continued to apply those requirements in the well permit application process, despite both the judgment of the court and the court’s denial of the department’s request that the court reconsider its invalidation of these specific provision,” the PIOGA said in a statement.
