Cecil Twp. sued by inspection company

A Pittsburgh-based company is claiming Cecil Township failed to pay nearly $100,000 for building inspections and construction document reviews that were conducted over a two-year period.

Code.sys Code Consulting, Inc. filed a complaint against Cecil Township in Washington County Court Friday. The company claims it was not compensated for work performed between March 2013 and January totaling $99,919, according to court records.

Cecil’s board of supervisors voted during the January reorganization meeting to replace Code.sys with Municipal Consulting Service, according to township manager Don Gennuso.

The complaint, filed by attorney Edward C. Spontak of Pettit & Spontak, said the company entered a written contract with the township in August 2011 to carry out work related to permit inspections and construction documents. The contract outlined a monthly payment schedule for services that had been performed the previous month, but Cecil fell behind on its bills, the company argued.

“Code.sys has repeatedly demanded payment on the outstanding invoices and Cecil has failed to pay same,” the complaint stated.

“Cecil has communicated to Code.sys that it is withholding payment for the unpaid document review work invoices as set forth above to attempt to ensure that Code.sys finalizes any outstanding inspection/permit work.”

The company received its termination notice from Cecil Township Jan. 7. The complaint alleged the township failed to pay two invoices from February.

The company claimed the township breached its contract and received “unjust enrichment” for failing to pay for work that was “ultimately used in furtherance of Cecil Township projects to the benefit of Cecil.”
