Attorneys for Canon-McMillan School District have dropped the U.S. Postal Service from a condemnation lawsuit regarding the potential takeover of a parcel next to the site of the new Muse Elementary School in Cecil Township.

The move pushes the case out of federal jurisdiction and back into Washington County Common Pleas Court.

On April 23, the school board directed the law firm Peacock, Keller and Ecker to go after the 70- by 200-foot parcel that has a post office on the premises. The land is owned by Grace, Dominick, Michael and Robert DiMatteo, according to court documents filed Tuesday.

The Postal Service leases the property at 200 Muse Bishop Road.

Postal Service spokesman Tad Kelley said the agency plans to continue operations under its lease through 2020.

Attorneys for the parties involved in the suit could not be reached Tuesday.
