Jury selection held for man charged in brother’s death
Juror selection was underway late Monday afternoon for the trial of a Jefferson Township man in the fatal shooting of his brother in late 2013.
Robert Jay Bauduin’s trial on a charge of criminal homicide is set to begin Wednesday morning before Washington County Judge John F. DiSalle. It’s expected to last several days.
Bauduin, 47, is accused of shooting his brother, Richard Bauduin Jr., 47, of Colliers, W.Va., at the house where Robert Bauduin lived with his father.
Bauduin is accused of shooting his brother Nov. 30, 2013 following an argument at the house, which is on Bethel Ridge Road.
Prior to his appearance in court Monday, Bauduin turned down a deal with prosecutors in which he would have pleaded guilty to third-degree murder. In exchange, prosecutors offered to recommend a sentence of 10 to 20 years in prison.
A recording of Robert Bauduin and his father speaking to 911 dispatchers was played at a December 2013 preliminary hearing in the case.
In the recording, Robert Bauduin allegedly told a dispatcher he’d killed his brother after a gunshot is heard.
Bauduin allegedly told state police who interviewed him that night he had gone to sleep in his bedroom. When his door opened, he picked up a shotgun he would keep nearby when he slept and fired a shot.
DiSalle previously denied a motion to suppress self-incriminating statements that Bauduin allegedly made to state police on the night of the shooting.
Assistant Public Defender Rose Semple, who is representing Bauduin, sought to suppress the statements because he was intoxicated and therefore unable to understand what he was doing when he spoke to police.
DiSalle concluded, based on troopers’ testimony and audio and video from the interview, Bauduin may have been intoxicated but had the capacity to know what he was saying.
Bauduin is denied bail and being held in Washington County jail.
