Nemacolin man acquitted of driving under the influence

WAYNESBURG – A Nemacolin man was acquitted of driving under the influence of a controlled substance during a nonjury trial Wednesday before Greene County Judge Lou Dayich.

David W. Smith, 25, of 126 Bliss Ave., was arrested by Cumberland Township police Feb. 19 when he went to the home of his ex-girlfriend at 330 Grant St., Nemacolin, and demanded to see her. Police said Smith was told by the home owner he was not permitted to be at the residence.

Police said Smith, who drove to the residence, smelled of alcohol. After being given a field sobriety test, he was arrested and taken to receive a blood test. However, the test indicated he was under the influence of Suboxone. Court records indicate he had a prescription for the drug.

Dayich also found Smith not guilty of disorderly conduct.

Smith was returned to Greene County jail, where he is serving an 18 to 60 month sentence he received in June for statutory sexual assault and other charges involving a 15-year-old Crucible girl.
