Suit claiming chicken manure led to breathing issues nixed
HARRISBURG, Pa. (AP) — An appeals court has rejected a Pennsylvania man’s attempt to blame his health problems on his work shoveling manure decades ago at a school for needy children.
A Superior Court panel Tuesday agreed with a county judge’s decision to dismiss Edward Krishack’s lawsuit against the Milton Hershey School, which he attended from 1948 to 1953.
The judge and the appeals court agree Krishack failed to connect his current lung problems to the farm work he and other students were required to perform.
The judge noted Krishack developed emphysema from smoking a pack-and-a-half of cigarettes daily for 40 years. Krishack had argued a calcified deposit on one of his lungs resulted from inhaling fungus on hay and chicken manure.
