Grand jury indicts convicted sex offender
PITTSBURGH – A federal grand jury has returned an indictment against Clayton Mitchell, 31, of Washington, on a charge of failing to register as a sex offender.
U.S. Attorney David J. Hickton announced Wednesday that Mitchell, who had been convicted of rape in 2010, failed to register and update a registration under the Sex Offender Registration and Notification Act.
City police charged Mitchell, a former resident of Detroit, Mich., and Huntingdon, in October 2009.
Mitchell entered a guilty plea in Washington County Court in March 2010 to a felony charge of rape of an unconscious victim. Judge Janet Moschetta Bell sentenced him to four to eight years in prison. His court file was sent to the state parole board in December 2013.
According to the indictment presented to the court, Mitchell was not in compliance with registration and reporting requirements from Oct. 23, 2015, to Feb. 16 of this year.
The law provides for a maximum sentence of 10 years in prison, a fine of $250,000, or both. Under federal sentencing guidelines, the actual sentence imposed would be based upon the seriousness of the defendant’s offense and any prior criminal history.
