Waynesburg woman resentenced for selling heroin in 2013

WAYNESBURG – A Waynesburg woman who pleaded guilty to selling heroin in April 2013 was resentenced Tuesday to state intermediate punishment after violating conditions of her previous county sentence.

Devon R. Garrett, 25, of 176 Huffman St., pleaded guilty in January 2014 to possession of a controlled substance, possession with intent to deliver a controlled substance and delivery of a controlled substance, for selling heroin while at Greene Plaza in Franklin Township in April 2013.

Greene County President Judge Farley Toothman sentenced Garrett to five years of county intermediate punishment in August 2014.

District Attorney Marjorie Fox recommended state intermediate punishment at the time because Garrett violated provisions of her bail three times. But in a 12-page sentencing order, Toothman cited Garrett’s two children, her lack of a previous criminal record and her three completed drug rehabilitation programs at inpatient facilities.

As part of the two years she will now serve in state intermediate punishment following her resentencing, Garrett must undergo drug and alcohol treatment. Toothman also sentenced her to two years of county probation, which must be served following her completion of the state sentence, with credit for 187 days served.

“I very much consent to the (state intermediate punishment) program,” Garrett said in court Tuesday through a video conference. “I absolutely believe that I will benefit from this.”

The conditions of her previous county sentence that Garrett violated was not divulged during the hearing and Toothman’s sentencing order was not immediately available for public review.
