Judge won’t dismiss suits over 2009 sandwich shop shooting
ALTOONA (AP) – A judge has declined to dismiss lawsuits stemming from a 2009 central Pennsylvania sandwich shop robbery and shooting that killed two people and injured a third.
The (Altoona) Mirror reports that the Blair County judge ruled that the issues raised should be considered by a jury rather than a judge.
Three lawsuits have accused the parents of Nicholas Horner of negligently entrusting their son with a handgun. Horner is serving life in the shootings of 19-year-old clerk Scott Garlick and 64-year-old bystander Raymond Williams during a robbery of the Altoona Subway shop in April 2009.
Attorney Zimmer Kunz, representing the parents, cited a lack of supporting evidence such as a date when Nicholas Horner took possession of the gun. He also argued that Horner had four other guns.
