Waynesburg man convicted of DUI in Route 19 crash

WAYNESBURG – A Waynesburg man was found guilty of driving under the influence of alcohol and other charges following a nonjury trial last week before Greene County President Judge Farley Toothman.

Frank Steven Borovichka, 64, of 515 Purman Run Road, was charged with DUI, false reports and four summary traffic violations after he crashed his pickup truck into a guardrail Jan. 14, 2015, on Route 19 in Washington Township.

State police said Borovichka left the scene of the crash and when they contacted him at his home, he first told them his wife was driving the vehicle alone and crashed.

Police said, however, his wife could provide no specific details about the crash, which led them to believe she was not the driver. Borovichka then admitted he was driving.

Another driver who was following Borovichka also testified at trial the driver of the pickup truck was speeding and driving erratically before the crash.

Borovichka was found guilty of all charges including DUI, incapable of driving safely.

A charge of DUI based on his blood-alcohol content was withdrawn, based on a recent U.S. Supreme Court decision requiring police to obtain a search warrant to draw the blood of motorists arrested on suspicion of drunk driving. Under the court ruling, warrants are not required for breathalyzer tests.

Borovichka will be sentenced following preparation of a pre-sentence report.
