Rogersville man found not guilty of DUI
WAYNESBURG – A Rogersville man was found not guilty Thursday of driving under the influence of alcohol and four summary traffic violations during a nonjury trial in September before Greene County President Judge Farley Toothman.
Jon Richard Lightner, 54, was stopped by state police Sept. 17, 2016, after they saw his vehicle cross over the fog line several times on Route 18/21 in Franklin Township.
Police said Lightner smelled of alcohol, had glassy, bloodshot eyes and tested positive for alcohol use on a portable breath test. A blood test conducted at WHS-Greene indicated a blood-alcohol content of 0.155 percent.
In finding Lightner not guilty, Toothman stated in his order, he had not found evidence against Lightner adequate to be “beyond a reasonable doubt.”
In another matter, Elijah M. David, 19, of 1397 Jefferson Road, Jefferson, pleaded guilty before Judge Lou Dayich to unauthorized use of a vehicle and was sentenced to time served to 1 year in jail. He also was fined $200 and ordered to perform 60 hours of community service.
On Jan. 19, David took his grandfather’s car without his grandfather’s permission. He returned the car later and told his grandfather the vehicle had been damaged.
