Masontown man resentenced on firearm, other charges

WAYNESBURG – A Masontown man who was sentenced last year to 8 to 16 years in prison for threatening two Carmichaels women with a gun in May 2015 was resentenced Tuesday to a lighter prison term.

Robert Jermaine Bailey, 43, of 38 Fort Mason Village, was initially sentenced in March after a jury convicted him of burglary, possession of a firearm, terroristic threats, recklessly endangering another person, simple assault and possession of a small amount of marijuana.

Greene County Judge Louis Dayich resentenced Bailey to 5 to 10 years in prison during a hearing Tuesday morning.

Bailey pointed a small black pistol at Jennifer Colina and Tiffany Prescher May 24, 2015, at a house at 151 Cumberland Village and threatened to shoot one of them in the face. Bailey knocked a telephone from Colina’s hand when she attempted to call police, and told the women if they went to police he would shoot them or “have his girl call some people out to do it for him,” Cumberland Township police said.

Police were informed Bailey might be at a house down the street and when they went there, they saw him in the backyard. He jumped over a chain-link fence and ran away. A small black pistol was later found in the area.

Police said they later found Bailey hiding in the basement of a house at 200 S. Market St. An occupant of an apartment at the same address later told police Bailey pushed his way into her residence and demanded clothing. He was given pants, a shirt and a hat before leaving.

A month after Bailey’s sentencing, his attorney at the time, Patrick Fitch, filed a post-sentencing motion to dismiss the burglary charge, since the jury acquitted him of criminal trespass, theft and receiving stolen property.

Assistant District Attorney Brianna Vanata explained that since burglary is defined as breaking and entering a building with intent to commit a crime, and since Bailey was acquitted of all charges from the incident in the residence, the court also dismissed the burglary charge.

Bailey had to be resentenced following the dismissal of the burglary charge. He was given credit for time served since his arrest in May 2015.

Bailey’s new attorney, Kevin Freyder, said in court Tuesday that Bailey will probably appeal the new sentence. Bailey testified in court that he missed spending time with his children and that he wants to “get my life back.”

“This whole situation got blew out of proportion,” he said. “I didn’t do what they said I did. I know I didn’t have a gun. This whole case is hearsay.”
