A 20-year-old Mt. Morris man was charged Thursday by state police with statutory sexual assault for allegedly having sex with a 15-year-old girl during a party at his residence April 1.

Police said Levi James Daly, of 388 Big Shannon Run Road, was 19 in April, when he had a party at his house. Police said the girl had been drinking alcohol at the party, before she and Daly went into his bedroom and had sex.

Daly told police that before they had sex, the girl told him she was 17 years old. Daly told police that “he thought he was set up,” the criminal complaint said.

Daly is free on $10,000 unsecured bond and his preliminary hearing is scheduled for 2 p.m. June 20 before District Judge Jesse Cramer.
