Monessen resident sues Charleroi, PennDOT, contractor

LaVern Smith of Short Street, Monessen, filed suit in Washington County Court against Charleroi, PennDOT and a contractor from Allegheny County in connection with her fall in what she called “heavy tar” at an intersection in Charleroi that was under repair.

Smith was walking in the 400 block of Fallowfield Avenue on May 13, 2016, at an unnamed intersection when she lost her balance and fell, suffering an ankle injury that required reconstructive surgery.

She alleges that she will need at least one other surgery and possibly more.

Smith named as defendants in the suit Charleroi Borough, PennDOT and R&B Contracting and Excavation Inc., Buttermilk Hollow Road, West Mifflin, claiming they were responsible for the road’s unsafe condition, about which they failed to warn those who were crossing.

She is seeking compensation for lost earnings, pain and suffering and medical care including physical therapy. A court date has not yet been set.
