WAYNESBURG – The man shot by armed intruders during a scuffle at his Waynesburg home in March testified Monday that the alleged shooter had occasionally purchased Subutex from his fiancée and demanded more the night of the attack.

Johnathan Fannon said he immediately recognized Cody Jannenga when he and another man wearing a mask entered Fannon’s apartment at 53 S. Morris St. late on March 26 and demanded he give them all of his “stuff.”

Fannon said his fiancée, Brandi Stump, had sold his prescription Subutex pills that are used to curb opioid cravings to Jannenga about once a week, but he still owed $60 from previous purchases, so she wouldn’t sell it to him again. That triggered an argument earlier in the day, which Fannon suspected prompted Jannenga and an acquaintance, Kody Alan Scott, to barge into his apartment and assault him before Jannenga allegedly shot him once in the leg with what appeared to be a type of muzzleloader.

Following Fannon’s testimony during Monday’s preliminary hearing, District Judge Glenn Bates ordered Jannenga, 21, of Piney Flats, Tenn., to stand trial on charges of attempted homicide, aggravated assault, three counts of robbery, including one with specific intent to inflict serious bodily injury, harassment, theft, and three counts of conspiracy to commit robbery. He remains held at Greene County jail on $500,000 bond while awaiting trial.

Neither Fannon nor Stump was charged because they are cooperating with investigators.

It was the second time Fannon had testified against one of the intruders, the last during Scott’s preliminary hearing April 7 in which Bates held him for court on multiple felony counts of robbery and conspiracy, along with theft and harassment charges. Scott, 21, of 206 S. Washington St., Waynesburg, is being held in Greene County jail on $75,000 bond and scheduled to enter a plea July 12.

During the robbery, Fannon attempted to wrestle what he believed was a fake gun from Scott’s hands when he said Jannenga shot him once in the back of his left leg with the muzzleloader that fired four large BB pellets, three of which struck him. The three men continued to fight and fell down the stairs, Fannon said. He testified Jannenga punched him in the head at least 10 times with metal knuckles, leaving scars around his eye and forehead.

“That went on for a while and I couldn’t take it anymore,” Fannon said.

Concerned that he was losing too much blood, Fannon eventually gave up and directed them to the kitchen, where he handed over a bottle of his prescription Subutex. As the men left, Scott got lost in the house while Jannenga knew his way to the exit.

Neighbors helped to stop the bleeding in Fannon’s leg while waiting for Waynesburg police to arrive. He was treated at an area hospital and released the following day.

Scott was arrested a day after the shooting while Jannenga turned himself in to Tennessee authorities a week later.
