Greene County woman accused of sending child porn to husband ordered to stand trial

A Greene County woman accused of recording sexual acts with an 11-year-old girl and then sending them to her fugitive husband while he avoided police on his own child pornography charges was ordered to stand trial on all but a handful of the original charges.

No testimony was offered at Cheyenna Perry’s preliminary hearing Monday afternoon as prosecutors and her defense attorney agreed to amend one of the felony involuntary deviate sexual intercourse charges to a criminal solicitation of involuntary deviate sexual intercourse with a child. The other seven IDSI charges were dismissed, with all other charges held for court.

Perry’s defense attorney, Erick Rigby, made the unusual move of requesting District Judge Lee Watson hold the charges to court in order to address any outstanding legal issues as the case proceeds.

Perry was accompanied by several family members in the courtroom, where the only public portion included the explanation of the agreement from Assistant District Attorney Brianna Vanatta.

Perry, 35, of 197 Hartley Road, Monongahela Township, was charged April 25 of instructing an 11-year-old girl to pose in various sexual positions while taking videos and photographs last year. Perry previously told state police she was “under duress from her husband” when she sent photos and videos to Matthew Perry before U.S. marshals arrested him in Morgantown, W.Va., last August, according to the criminal complaint.

State police received a forensic analysis last month of a computer seized from Matthew Perry when he was arrested. Multiple photos and videos were found of a girl in a “naked provocative state,” court documents indicate. Police said Cheyenna Perry appears in one video with the child and is seen at the end shutting off the camera.

It is unclear if the images depict the same victim Matthew Perry is accused of raping. Police said the files were sent in July while he was evading arrest. Cheyenna Perry admitted during an interview with state police Tuesday she took the videos and photos of the 11-year-old girl and she directed the juvenile to perform the acts while recording them.

When investigators asked Cheyenna Perry why she did not contact police about the videos and photos after her husband was arrested last August, she said “she was embarrassed and things were going better since his apprehension.”

Held for court were charges of criminal solicitation of involuntary deviate sexual intercourse with a child, 15 counts each of knowingly photographing or filming a child performing sex acts, corruption of minors and disseminating photos or film of child sex acts, along with eight misdemeanor counts of indecent assault of a person less than 13.

Cheyenna Perry remains in Greene County jail on $100,000 bond to await her formal arraignment.

Matthew Perry, 39, was charged last June with rape of a child, involuntary deviate sexual intercourse, aggravated indecent assault, indecent assault and corruption of minors.

Matthew Perry has been undergoing mental health treatment at Torrance State Hospital near Blairsville since November after he was determined to be incompetent to stand trial. He is accused of an ongoing sexual relationship with an 11-year-old, allegedly beginning in the summer 2016 and continuing through March 2017.
