Westmoreland County man sentenced for sexual assault of teen

A Westmoreland County man who pleaded guilty earlier this month to sexually assaulting a teenage girl several years ago was sentenced last week to three years of County Intermediate Punishment.

James Patrick Biller, 24, of Mt. Pleasant, also was sentenced by Greene County Judge Lou Dayich to 45 days of incarceration with credit for 29 days served while he was jailed last year.

Cumberland Township police had arrested Biller and charged him with three counts of statutory sexual assault, along with several other charges that have been withdrawn. Police said they had received a tip from ChildLine in April 2017 before speaking with a 16-year-old girl who told police that Biller was a family friend who had assaulted her when she was 13.

The victim told police the assaults happened from October 2013 to January 2014, and that she didn’t immediately report it because she was afraid of Biller, who was 19 at the time. According to the criminal complaint, Biller forced the victim into sexual intercourse once in October, then again multiple times in January.

She told police that the two were involved in some sort of relationship at the time and that the assaults happened at her home, while her mother was in another room.

The court previously rejected a plea agreement of house arrest for Biller. Following his incarceration and as part of his CIP, Biller will serve 120 days of house arrest with release for employment and medical reasons. He also was ordered to have no contact with the victim and to pay $1,050 in fines.
