Police say Smith Township man nearly struck pedestrian, threatened to shoot officers

McDonald police filed several charges Monday against a Smith Township man who they say nearly hit a person while driving drunk and threatened to shoot officers.
Brandon Stewart McGivern, 29, of 40 Cherry Creek Road, faces misdemeanor charges of terroristic threats, resisting arrest, institutional vandalism, recklessly endangering another person, simple assault and driving under the influence.
The charges stem from an incident the evening of May 6.
According to the criminal complaint, McDonald police were called to Main Street in Burgettstown about 10 p.m. after a silver Chevrolet Silverado almost struck a man in his driveway.
Police spoke with McGivern’s cousin, Chad Stroud, who told officers that had been drinking with McGivern.
According to the complaint, McGivern pulled into his driveway and went into reverse “at a high rate of speed,” and struck the side of McElhaney Auto Garage, located next door at 1827 Main St.
Police observed damage to the building’s gutter and exterior.
McGivern continued to drive in reverse across Main Street and nearly hit Joseph Vladich, who was standing in his driveway, police said.
Stroud said he also been in a fight with McGivern. Stroud told police that McGivern spit in his face and then he hit McGivern in the face with his elbow, causing a large bruise under McGivern’s right eye.
Stroud was charged with simple assault and harassment for the incident.
Police said they found McGivern’s vehicle at his residence with “severe” damage to the passenger side. McGivern was standing in the doorway, and officers said they heard him say, “I will shoot them, too.”
According to the complaint, police attempted to arrest McGivern for driving under the influence, and he began to try to fight the arresting officers, damaging an officer’s body camera clip.
McGivern refused a blood test and allegedly spit in the police vehicle. Police charged McGivern for causing $200 in damage to the vehicle with his blood and saliva.
A preliminary hearing for McGivern has not been scheduled.
